I have read and agree to the following terms and conditions:

SPECIFIC TERMS OF SERVICE: (Vehicle & Walking Tour Waiver)
I, the purchaser, agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”). I waive any and all claims I may have now and in the future, and release from all liability and agree not to sue My Chauffeur Transportation LLC., its officers, agents, representatives, employees or tour guides [hereafter referred to as “Staff”] for any personal injury, death, property damage, or loss sustained by me as a result of my participation in My Chauffeur Bus or Walking Tours due to any cause whatsoever, including without limitation, negligence on the part of My Chauffeur Transportation LLC., its Staff, tour partners, or other participants, or death or injury as a result of war, vehicles, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
I am aware that the tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather or weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed bus or walking tour and the possibility of personal injury, death or property damage or loss resulting there from. I acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness My Chauffeur Transportation LLC. or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety.
I understand that photographs taken on this tour may only be used for non-commercial or personal purposes.
Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the bus or walking tour.
In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by My Chauffeur Transportation LLC. or its Staff or any other inducement or coercion to go on the bus or walking tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this bus or walking tour and Wavier and Release prior to signing it and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors.
I agree to grant the sponsors of this tour to a worldwide, royalty-free license to use my photographic, video, or digital likeness solely for promotional, educational, and/or commercial purposes.
As a participant on the tour, I accept full responsibility for my behavior, well-being, and health throughout the tour, which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: climbing stairs. I further realize that the tour may involve walking through unfamiliar, narrow and/or steep corridors, gangways, roads, crosswalks, stairways and driveways.
By purchasing your reservation, I affirm that I have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.
UNIVERSAL TERMS OF SERVICE: (Main points of this form);
· No Smoking Please – Smoking of any kind is prohibited
· Excessive public intoxication will not be tolerated and will result in tour termination. Merchants reserve the right to refuse service.
· Drink alcohol moderately and responsibly – All ‘Hard Alcohol’ (16% ABV or higher) is PROHIBITED inside our vehicles due to over consumption/inebriation. Beer (6.4% or lower) or wine (15% or lower) are allowed but STRONGLY DISCOURAGED inside our vehicles due to over consumption. (Exception: Beer & Distillery Tour w/product purchased in route). Beer (6.5% ABV or higher) or wine (16% ABV or higher) are PROHIBITED. ALL ALCOHOL IS PROHIBITED IF NOT ALL PARTICIPANT’S ARE AGE 21 or over. My Chauffeur is released & forever discharged from all responsibility related to damages, legal damages and/or injuries or death during and after this reservation caused from drinking alcohol or another reason.
· Sickness – Fines apply for sickness in or on the My Chauffeur vehicle. Please be pro-active & inform your driver.
· SEDAN & ALL OTHER VEHICLES – Alcohol consumption allowed in backseat(s) ONLY.

- MASKS ARE REQUIRED (SEDAN), OR REQUESTED (SHUTTLE BUS) TO BE PROPERLY WORN INSIDE THE VEHICLE AT ALL TIMES.
- VEHICLE WINDOWS WILL BE KEPT OPEN FOR VENTILATION.

- Food: For BYO food; please bring non-messy foods. My Chauffeur charges for food clean-up beyond the normal inside our vehicles See #11 Cleaning & Repairs under the service order agreement; below at bottom
- ALCOHOL: All hard alcohol (‘spirits’) is prohibited in My Chauffeur vehicles. Hard alcohol and/or empty hard alcohol bottles found in the vehicle may be subject to an immediate end of your reservation and/or fine in agreement with the contractual agreement (See Terms & Conditions #11). See FOOD & ALCOHOL, PART 1 on your reservation contract. Beer & wine are allowed* but not recommended due to over consumption. Purchased alcohol is requested to be put in the vehicle trunk. Passengers under 21 years of age may not consume alcohol but may be present if alcohol is present as long as they are accompanied by their parent.
- Upon completion of trip, YOU WILL NOT DRIVE IMPAIRED. Basically, if you consumed alcohol at any time during the duration of your My Chauffeur trip, arrange for alternate transportation. Lyft & Uber operate in Portland and elsewhere, and are quite reliable. Traditional taxi service is also available, though it is still a bit difficult on Friday/Saturday/Party Day nights. Again, you will not drive drunk. My Chauffeur will, on request, arrange for a driver or a taxi.
- All cleaning fees (beyond the normal) and damage fees will be paid for immediately and with no notice by charging your reservation agreement and a final price audit will be done after the conclusion of your reservation.
